Amplify Sports – Terms of Service

4. Disclaimer of Warranties:

• THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• AMPLIFY SPORTS DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• AMPLIFY SPORTS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE WEBSITE OR CONTENT IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

5. Limitation of Liability:

• AMPLIFY SPORTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE WEBSITE OR CONTENT, EVEN IF AMPLIFY SPORTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Indemnification:

• You agree to indemnify and hold harmless Amplify Sports, its officers, directors, employees, agents, and licensors from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys’ fees, arising out of or in connection with your use of the Website or your violation of this Agreement.

7. Termination:

• Amplify Sports may terminate your access to the Website at any time, for any reason, without notice.
• Upon termination, your right to use the Website will immediately cease.

8. Governing Law:

• This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of laws provisions.

9. Entire Agreement:

• This Agreement constitutes the entire agreement between you and Amplify Sports regarding the use of the Website.

10. Severability:

• If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

11. Waiver:

• No waiver of any provision of this Agreement shall be effective unless in writing and signed by both you and Amplify Sports.
